4、ision of the State Council to Amend and Repeal Certain Administrative Regulations on March 29, 2022Regulation on Pesticide AdministrationChapter I General ProvisionsIn case of the consigned processing or subpackaging of pesticides, the consignor shall obtain the corresponding pesticide registration

5、certificate, and the consignee shall obtain the pesticide production license.The consignor shall be responsible for the quality of the pesticides under consigned processingor sub-packaging.Article 19 A pesticide production enterprise shall, when purchasing raw materials, examine the product quality

6、conformity certificate and the relevant licensing and certification documents, and may not purchase or use the raw materials to which no product quality conformity certificate is attached in accordance with the law or for which no relevant licensing or certification document has been obtained in acc

7、ordance with the law.A pesticide production enterprise shall establish a raw material purchase recording system to truthfully record the name of raw materials, licensing or certification document number, specifications, quantity, name and contact information of the supplier, date of purchase of the

8、raw materials and other contents. The raw material purchase records shall be retained for a period of two years or more.Article 20 A pesticide production enterprise shall conduct production in strict accordance with product quality standards, so as to ensure the consistency between pesticide product

9、s and the registered pesticides. Pesticides may not leave the factory for sale until they pass the quality inspection and are accompanied with product quality conformity certificates.A pesticide production enterprise shall establish a recording system for pesticides leaving the factory for sale, tru

10、thfully record the name, specifications, quantity, production date and batch number of pesticides, product quality testing information, the name and contract information of the purchaser, sales date and other contents. 15、d other contents.农药标签应当按照国务院农业 主管部门的规定，以中文标注 农药的名称、剂型、有效成分 及其含量、毒性及其标识、使 用范围、使用方法和剂量、使 用技术要求和考前须知、生产 日期、可追溯电子信息码等内 容。The labels of extremely and highly toxic pesticides, other pesticides with strict use technical requirements and other pesticides the use of which is restricted shall also be indicate

18、Where pesticide packages are too small to indicate all thecontents, the instructions thereof shall be attached at the农药包装过小，标签不能标注全部内容的，应当同时附具说same time. 19、章农药经营11第二十四条国家实行农 药经营许可制度，但经营卫生 用农药的除外。农药经营者应 当具备以下条件，并按照国务 院农业主管部门的规定向县级 以上地方人民政府农业主管部 门申请农药经营许可证：Article 24 The state shall implement a system of pesticide operation permit , excluding the operation of sanitary pesticides. A pesticide operator shall meet the following conditions and apply for a pe

20、sticide operation permit to the competent agricultural department of the local peoples government at or above the county level in accordance with the provisions of the competent agricultural department of the State Council:（一）有具备农药和病虫害防 治专业知识，熟悉农药管理规 定，能够指导平安合理使用农 药的经营人员；(1) Having the operating per

21、sonnel that have professional knowledge in pesticides and the pests control , are familiar with the provisions on pesticide administration, and are capable of guiding the safe and rational use of pesticides.（二）有与其他商品以及饮用 水水源、生活区域等有效隔离 的营业场所和仓储场所，并配 备与所申请经营农药相适应的 防护设施；(2) Having the business premises

22、 and warehouses that are effectively isolated from other commodities and drinking water sources and living areas, among others, and being equipped with the protective facilities commensurate with the pesticides it applies for operation.（三）有与所申请经营农药相 适应的质量管理、台账记录、 平安防护、应急处置、仓储管 理等制度。(3) Having the ru

26、the acceptance of the application, make an approval or disapproval decision. If the conditions arc satisfied, the pesticide operation permit shall be issued; or if the conditions arc not satisfied, the applicant shall be notified in writing and the reasons therefor shall be given.第二十五条农药经营许 可证应当载明农药

27、经营者名 称、住所、负责人、经营范围 以及有效期等事项。Article 25 A pesticide operation permit shall specify the name, domicile, person in charge, operation scope and period of validity of the pesticide operator and other relevant matters.农药经营许可证有效期为5 年。有效期届满，需要继续经 营农药的，农药经营者应当在 有效期届满90日前向发证机 关申请延续。A pesticide operation permi

28、t shall be valid for five years. Where the operation of pesticides needs to be continued upon the expiration of the period of validity, the pesticide operator shall apply to the permit-issuing authority for the renewal thereof 90 days before the expiration of the period of validity.农药经营许可证载明事项发生 变化的

29、，农药经营者应当按照 国务院农业主管部门的规定申 请变更农药经营许可证。Where any matter as specified on a pesticide operation permit changes, the pesticide operator shall apply for the change of the pesticide operation permit in accordance with the provisions of the competent agricultural department of the Stale Council.取得农药经营许可证的农药经

30、 营者设立分支机构的，应当依 法申请变更农药经营许可证， 并向分支机构所在地县级以上 地方人民政府农业主管部门备 案，其分支机构免予办理农药 经营许可证。农药经营者应当 对其分支机构的经营活动负 责。Where a pesticide operator that has obtained a pesticide operation permit forms a branch office, it shall apply for changing the pesticide operation permit in accordance with the law, and undergoes th

31、e recordation formalities with the competent agricultural department of the local peoples government at or above the country level at the place where the branch office is located, and its branch office shall be exempt from handling the pesticide operation permit. A pesticide operator shall be respon

32、sible for the distribution activities of its branch offices.第二十六条农药经营者 采购农药应当查验产品包装、 标签、产品质量检验合格证以 及有关许可证明文件，不得向 未取得农药生产许可证的农药 生产企业或者未取得农药经营 许可证的其他农药经营者采购 农药。Article 26 A pesticide operator shall, when purchasing pesticides, check product packaging, labels, product quality conformity certificates an

33、d relevant permit and certification documents, and may not purchase pesticides from a pesticide production enterprise that fails to obtain the pesticide production license or any other pesticide operator that fails to obtain the pesticide operation permit.农药经营者应当建立采购台 账，如实记录农药的名称、有 关许可证明文件编号、规格、 数量、

36、rator shall establish a sales ledger to truthfully record the name, specifications, quantity, production enterprise, purchaser, and sales date of the pesticides and other contents. A sales ledger shall be retained for two years or more.A pesticide operator shall inquire of the purchaser about the oc

37、currence of plant diseases and insect pests and recommend pesticides in a scientific manner; and, if necessary, shall conduct field investigation of the occurrence of plant diseases and insect pests, and correctly explain the use scope, use methods and dosage of pesticides, use technical requirement

38、s and matters needing attention, and may not mislead the purchaser.经营卫生用农药的，不适用本 条第一款、第二款的规定。The provisions of paragraphs 1 and 2 of this Article shall not apply to the operation of sanitary pesticides.第二十八条农药经营者 不得加工、分装农药，不得在 农药中添加任何物质，不得采 购、销售包装和标签不符合规 定，未附具产品质量检验合格 证，未取得有关许可证明文件 的农药。Article 28 A

39、pesticide operator shall not process or subpackage pesticides, add any substances to pesticides, or purchase or sell the pesticides whose packages or labels fail to meet the relevant provisions, or which fail to be attached with product quality conformity certificates or obtain the relevant permit a

40、nd certification materials.经营卫生用农药的，应当将卫 生用农药与其他商品分柜销 售；经营其他农药的，不得在 农药经营场所内经营食品、食 用农产品、饲料等。Where sanitary pesticides are operated, sanitary pesticides and other commodities shall be sold at separate counters; or where other pesticides are operated, it is not allowed to operate food, edible agricultu

41、ral products or feed, among others, at the operation places of pesticides.第二十九条境外企业不 得直接在中国销售农药。境外 企业在中国销售农药的，应当 依法在中国设立销售机构或者Article 29 Overseas enteiprises shall not directly sell pesticides in China. If an overseas enterprise sells pesticides in China, it shall form a sales organization in China

42、or authorize a qualified Chinese agency to sell such pesticides in accordance with the law.委托符合条件的中国代理机构 销售。Pesticides exported to China shall be accompanied by Chinese labels and instructions, meet the product quality standards, and pass the inspection by the entry-exit inspection and quarantine de

43、parlments in accordance with the law. It is prohibited from importing the pesticides that fail to obtain pesticide registration certificates.向中国出口的农药应当附具中 文标签、说明书，符合产品质 量标准，并经出入境检验检疫 部门依法检验合格。禁止进口 未取得农药登记证的农药。When the customs declaration formalities for import and export of pesticides are undergone,

44、 the relevant certification documents shall be produced in accordance with the provisions of the General Administration of Customs.办理农药进出口海关申报手 续，应当按照海关总署的规定 出示相关证明文件。Chapter V Pesticide Use第五章农药使用Article 30 The competent agricultural departments of the peoples governments at or above the county lev

45、el shall strengthen the guidance to and the services for pesticide use, establish and improve the system for the safe and rational use of pesticides, and, according to the requirements of prevention first, and comprehensive prevention and control,“ organize the promotion of the scientific pesticide

46、use technologies, and regulate the pesticide use. The departments of forestry, grains and sanitation shall strengthen the technical guidance to the safe and rational use of pesticides for forestry, grain storage and sanitation, and the competent deparlments of environmental protection shall strength

47、en the technical guidance to the environmental protection and pollution prevention and control in the process of pesticide use.第三十条县级以上人民 政府农业主管部门应当加强农 药使用指导、服务工作，建立 健全农药平安、合理使用制 度，并按照预防为主、综合防 治的要求，组织推广农药科学 使用技术，规范农药使用行 为。林业、粮食、卫生等部门 应当加强对林业、储粮、卫生 用农药平安、合理使用的技术 指导，环境保护主管部门应当 加强对农药使用过程中环境保 护和污染防治的技术指

48、导。Article 31 The competent agricultural departments of the peoples governments at the county level shall organize plant protection, agricultural technology promotion and other organizations to provide free technical trainings for pesticide users, and improve the level of safety and rational use of p
