5、ions on November 29, 2020)Chapter 1 General ProvisionsArticle 1 These Regulations are formulated in order to strengthen the administration of printing industry, to protect the lawful rights and interests of the operators of printing industry and the public interests of the society, and to promote th

8、d decoration, a printing enterprise shall validate the business license of the unit or the resident identity cards of the individuals that entrusted the printing; when accepting the entrustment of advertisement operators to print advertisement publicity material, the printing enterprise shall also v

9、alidate the qualification certificates of advertisement operations.第二十七条印刷企业接受 委托印刷广告宣传品、作为产品 包装装潢的印刷品的，应当验证 委托印刷单位的营业执照或者个 人的居民身份证；接受广告经营 者的委托印刷广告宣传品的，还 应当验证广告经营资格证明。Article 28 When accepting entrustment to print printed matters of package and decoration, a printing enterprise shall hand over all o

10、f the finished products, half-finished products and wasters of the printed matters, and the printing negatives, paper types, photographic plates, manuscripts, etc, to the unit or individual that entrusted the printing, and may not keep those things without authorization.第二十八条印刷企业接受 委托印刷包装装潢印刷品的，应 当将

11、印刷品的成品、半成品、废 品和印板、纸型、底片、原稿等 全部交付委托印刷单位或者个 人，不得擅自留存。Article 29 When accepting entrustment to print foreign printed matters of package and decoration, a printing enterprise must report to the administrative department of publishing of the people* s government of the province, autonomous region, munici

12、pality directly under the Central Government of the place where the enterprise is located for record in advance; and the printed matters of package and decoration must be transported outside China and may not be sold within the borders.第二十九条印刷企业接受 委托印刷境外包装装潢印刷品 的，必须事先向所在地省、自治 区、直辖市人民政府出版行政部 门备案；印刷的包

13、装装潢印刷品 必须全部运输出境，不得在境内 销售。Chapter 5 Printing of Other Printed Matters第五章其他印刷品的印刷io第三十条印刷标有密级的 文件、资料、图表等，按照国家 有关法律、法规或者规章的规定 办理。第三十一条印刷布告、通 告、重大活开工作证、通行证、 在社会上流通使用的票证的，委 托印刷单位必须向印刷企业出具 主管部门的证明。印刷企业必须 验证主管部门的证明，并保存主 管部门的证明副本2年，以备查 验；并且不得再委托他人印刷上 述印刷品。印刷机关、团体、部队、企业事 业单位内部使用的有价票证或者 无价票证，或者印刷有单位名称 的介绍信、工作

14、证、会员证、出 入证、学位证书、学历证书或者其他学业证书等专用证件的，委 托印刷单位必须出具委托印刷证 明。印刷企业必须验证委托印刷 证明。印刷企业对前两款印件不得保存 样本、样张；确因业务参考需要 保存样本、样张的，应当征得委 托印刷单位同意，在所保存印件 上加盖“样本”、“样张”戳 记，并妥善保管，不得丧失。第三十二条 印刷企业接受 委托印刷宗教用品的，必须验证 省、自治区、直辖市人民政府宗 教事务管理部门的批准文件和 省、自治区、直辖市人民政府出 版行政部门核发的准印证；省、 自治区、直辖市人民政府出版行Article 30 The printing of documents, mate

The printing enterprise must verify the certificate issued by the competent department and keep a copy of the certificate for two years for future inspection; and shall not authorize others to print the aforesaid printed m

17、atters.To print the value instruments or unvalued instruments used inside the organs, organizations, armies, enterprises or institutions, or the special certificates such as the letters of introduction, employees cards, members cards, passes, degree certificates, academic background certificates or

18、other academic certificates, etc, that bear the unit names, the unit that entrusts the printing must provide the certificate of printing entrustment. And the printing enterprise must validate the certificate of printing entrustment.The printing enterprise may not keep the samples, specimen pages of

19、the printed letters prescribed in the preceding two paragraphs; if the samples, specimen pages do need to be kept because of business reference needs, the approval of the unit that entrusted the printing shall be obtained, and the countermark of sample； specimen page“ shall be sealed on the printed

20、letters kept which shall be preserved in good conditions and may not be lost.Article 32 When accepting entrustment to print articles for religious use, a printing enterprise must validate the approving documents of the administrative department in charge of religious affairs of the people* s governm

21、ent of the province, autonomous region, municipality directly under the Central Government and the certificate of printing permission issued by the administrative department of publishing of the people* s government of the province, autonomous region, municipality政部门应当自收到印刷宗教用品 的申请之日起10日内作出是否 核发准印证的

22、决定，并通知申请 人；逾期不作出决定的，视为同 意印刷。directly under the Central Government; the administrative departments of publishing of the people* s government of the province, autonomous region, municipality directly under the Central Government shall make the decision on whether to issue the certificate of printing p

23、ermission or not within 10 days since the date of receiving the application for printing articles for religious use, and shall notify the applicant of the decision; if no decision is made after the time limit, it is regarded that the approval is granted.第三十三条从事其他印刷品印刷经营活动的个人不得印刷 标有密级的文件、资料、图表 等，不得印刷

24、布告、通告、重大 活开工作证、通行证、在社会上 流通使用的票证，不得印刷机 关、团体、部队、企业事业单位 内部使用的有价或者无价票证， 不得印刷有单位名称的介绍信、 工作证、会员证、出入证、学位 证书、学历证书或者其他学业证 书等专用证件，不得印刷宗教用第三十四条接受委托印刷 境外其他印刷品的，必须事先向 所在地省、自治区、直辖市人民 政府出版行政部门备案；印刷的 其他印刷品必须全部运输出境， 不得在境内销售。第三十五条 印刷企业和从 事其他印刷品印刷经营活动的个 人不得盗印他人的其他印刷品， 不得销售、擅自加印或者接受第 三人委托加印委托印刷的其他印 刷品，不得将委托印刷的其他印 刷品的纸型

25、及印刷底片等出售、 出租、出借或者以其他形式转让Article 33 Individuals engaged in the operations of printing other printed matters may not print the documents, material, charts, etc that are marked with secrecy, may not print notices, announcements, employees cards for important activities, traffic permits, or tickets circ

26、ulated in the society, may not print the valued or unvalued instruments used inside the organs, organizations, armies, enterprises or institutions, may not print the special certificates such as letters of introduction, employees cards, members cards, passes, degree certificates, academic background

27、 certificates, or other academic certificates, and may not print articles for religious use.Article 34 Those accepting entrustment to print other foreign printed matters must report to the administrative departments of publishing of the people1 s government of the province, autonomous region, munici

28、pality directly under the Central Government of their locations for record; and those printed matters must be transported outside China and may not be sold within the borders.Article 35 No printing enterprise or individual engaged in the operations of printing other printed matters may illegally pri

29、nt the other printed matters of others without permission, neither may they sell, print more or accept the entrustment of a third party to print more of the other printed matters printed according to entrustment without authorization, or sell, rent, lend or transfer the paper types and printing nega

30、tives of the other printed matters printed according to entrustment to other unit or individual.12给其他单位或者个人。给其他单位或者个人。Chapter 6 Punishment Rules第六章罚那么第六章罚那么Article 36 Where, in violation of the provisions of this Regulation, an enterprise engaging in the printing of publications is formed without ap

31、proval or printing operations are conducted without approval, the enterprise or printing operations shall be banned by the publication administrative department and the administrative department for industry and commerce according to their statutory powers; the printed matters, illegal income, and s

32、pecial tools and equipment used for the illegal activities shall be confiscated; and a fine of not less than five times nor more than ten times the amount of illegal operation shall be imposed on the violator if the amount of illegal operation is 10,000 yuan or more or a fine of not less than 10,000

33、 yuan nor more than 50,000 yuan shall be imposed on the violator if the amount of illegal operation is less than 10,000 yuan; and if the violation is criminally punishable, the offender shall be held criminally liable according to the law.第三十六条 违反本条例规 定，擅自设立从事出版物印刷经 营活动的企业或者擅自从事印刷 经营活动的，由出版行政部门、 工商行

34、政管理部门依据法定职权 予以取缔，没收印刷品和违法所 得以及进行违法活动的专用工 具、设备，违法经营额1万元以 上的，并处违法经营额5倍以上 10倍以下的罚款；违法经营额 缺乏1万元的，并处1万元以上 5万元以下的罚款；构成犯罪 的，依法追究刑事责任。The printing factories (institutes) established inside the units without going through the procedures according to the provisions of Chapter 2 of these Regulations shall be p

35、unished according to the provisions of the preceding paragraph, if they undertake printing operations.单位内部设立的印刷厂（所）未依 照本条例第二章的规定办理手 续，从事印刷经营活动的，依照 前款的规定处分。Article 37 If an operator of the printing industry, in violation of the provisions of these Regulations, has committed any of the following acts,

36、 the administrative department of publishing of the local peoples government shall order him to stop the illegal act, order him to stop business for internal rectification, confiscate the printed matters and illegal earnings, and shall impose a fine of more than 5 times and less than 1() times of th

37、e illegal earnings on him if the illegal earnings are 10, 000 Yuan or more; a fine of more than 10,000 Yuan and less than 50,000 Yuan shall be imposed on him if the illegal earnings are less than 10, 000 Yuan; the former license-issuing organ shall revoke the license if the circumstances are serious

38、; and criminal responsibilities shall be investigated into according to law if a crime is constituted.第三十七条印刷业经营者 违反本条例规定，有以下行为之 一的，由县级以上地方人民政府 出版行政部门责令停止违法行 为，责令停业整顿，没收印刷品 和违法所得，违法经营额1万元 以上的，并处违法经营额5倍以 上10倍以下的罚款；违法经营 额缺乏1万元的，并处1万元以 上5万元以下的罚款；情节严重 的，由原发证机关撤消许可证； 构成犯罪的，依法追究刑事责 任：13（一）未取得出版行政部门的许 可，擅自

39、兼营或者变更从事出版 物、包装装潢印刷品或者其他印 刷品印刷经营活动，或者擅自兼 并其他印刷业经营者的；（一）未取得出版行政部门的许 可，擅自兼营或者变更从事出版 物、包装装潢印刷品或者其他印 刷品印刷经营活动，或者擅自兼 并其他印刷业经营者的；1) Without obtaining the permission of the administrative department of publishing, operating concurrently or changing the printing operations of publications, printed matters o

40、f package and decoration or other printed matters without authorization, or annexing other operators of the printing industry to itself/himself without authorization;（二）因合并、分立而设立新的印 刷业经营者，未依照本条例的规 定办理手续的；（二）因合并、分立而设立新的印 刷业经营者，未依照本条例的规 定办理手续的；2) Having not gone through the procedures according to the

41、 provisions of these Provisions when establishing new operators of the printing industry because of merger or division; or（三）出售、出租、出借或者以其 他形式转让印刷经营许可证的。（三）出售、出租、出借或者以其 他形式转让印刷经营许可证的。3) Selling, renting, lending or transferring the license for printing operations by other means.第三十八条印刷业经营者 印刷明知或者应知含有

42、本条例第 三条规定禁止印刷内容的出版 物、包装装潢印刷品或者其他印 刷品的，或者印刷国家明令禁止 出版的出版物或者非出版单位出 版的出版物的，由县级以上地方 人民政府出版行政部门、公安部 门依据法定职权责令停业整顿，Article 38 If an operator of the printing industry prints the publications, printed matters of package and decoration, or other printed matters that contain the contents prohibited by Article

43、3 of these Regulations, and this he is fully aware of or should have known, or prints the publications prohibited publicly by state orders or the publications published by nonpublishing units, the administrative department of publishing and the public security department of the local peoples governm

44、ent at the county level or above shall order him to stop business for internal rectification, confiscate the printed matters没收印刷品和违法所得，违法经 营额1万元以上的，并处违法经 营额5倍以上10倍以下的罚 款；违法经营额缺乏1万元的， 并处1万元以上5万元以下的罚 款；情节严重的，由原发证机关 撤消许可证；构成犯罪的，依法 追究刑事责任。没收印刷品和违法所得，违法经 营额1万元以上的，并处违法经 营额5倍以上10倍以下的罚 款；违法经营额缺乏1万元的， 并处1万元以

45、上5万元以下的罚 款；情节严重的，由原发证机关 撤消许可证；构成犯罪的，依法 追究刑事责任。第三十九条印刷业经营者 有以下行为之一的，由县级以上 地方人民政府出版行政部门、公 安部门依据法定职权责令改正， 给予警告；情节严重的，责令停 业整顿或者由原发证机关撤消许 可证：and illegal earnings, and a fine of more than 5 times and less than 10 times of the earning from illegal operations shall be imposed on him if the earning from ille

47、riminal responsibilities shall be investigated into according to law if a crime is constituted.Article 39 If an operator of the printing industry has committed any of the following acts, the administrative department of publishing and the public security department of the local peoples government at

48、 the county level or above shall order him to make corrections and give him warnings according to their legal authorities; if the circumstances are serious, they shall order him to stop business for internal rectification, or the former license-issuing organ shall revoke the license:（一）没有建立承印验证制度、承1
