4、tions on March 2, 2019)Article 1 In order to regulate the recall of defective auto products, strengthen supervisionemergency disposal methods for avoiding damage and measures taken by the manufacturer for eliminating defects, among others.处置方法和生产者消除缺陷的措 施等事项。The product quality supervision departmen

5、t of the State Council shall, in a timely manner, publish information on confirmed defective auto products and relevant information on recalls implemented by manufacturers.国务院产品质量监督部门应当及 时向社会公布已经确认的缺陷汽 车产品信息以及生产者实施召回 的相关信息。Auto owners shall cooperate with manufacturers in implementing recalls.车主应当配合

6、生产者实施召回。Article 19 For the recalled defective auto products, a manufacturer shall, in a timely manner, eliminate defects by taking measures such as amending or adding labels, repair, replacement or return of products.第十九条 对实施召回的缺 陷汽车产品，生产者应当及时采 取修正或者补充标识、修理、更 换、退货等措施消除缺陷。Manufacturers shall assume e

7、xpenses for elimination of defects and necessary expenses for transporting defective auto products.生产者应当承担消除缺陷的费用 和必要的运送缺陷汽车产品的费 用。Article 20 A manufacturer shall submit interim reports and a final report on recall in accordance with the provisions issued by the product quality supervision departmen

8、t of the State Council.第二十条生产者应当按照 国务院产品质量监督部门的规定 提交召回阶段性报告和召回总结 报告。10第二十一条国务院产品质 量监督部门应当对召回实施情况 进行监督，并组织与生产者无利 害关系的专家对生产者消除缺陷 的效果进行评估。第二十二条生产者违反本 条例规定，有下列情形之一的， 由产品质量监督部门责令改正； 拒不改正的，处5万元以上20万 元以下的罚款：（一）未按照规定保存有关汽车 产品、车主的信息记录；（二）未按照规定备案有关信 息、召回计划；（三）未按照规定提交有关召回 报告。第二十三条违反本条例规 定，有下列情形之一的，由产品 质量监督部门责令

9、改正；拒不改 正的，处50万元以上100万元以 下的罚款；有违法所得的，并处 没收违法所得；情节严重的，由 许可机关吊销有关许可：Article 21 The product quality supervision department of the State Council shall conduct supervision over the implementation of recalls and organize experts without an interest relationship with manufacturers to evaluate the results of

10、 manufacturers* elimination of defects.Article 22 Where a manufacturer falls under any of the following circumstances in violation of the provisions of this Regulation, the product quality supervision department shall order it to make correction and, if the manufacturer refuses to do so, impose a fi

11、ne of not less than 50,000 yuan but not more than 200,000 yuan on the manufacturer:(1) Failing to preserve records of information on auto products and auto owners as required.(2) Failing to file relevant information or recall plans for recordation as required.(3) Failing to submit relevant recall re

12、ports as required.Article 23 Where a manufacturer or dealer falls under any of the following circumstances in violation of the provisions of this Regulation, the product quality supervision department shall order it to make correction, impose a fine of not less than 500,000 yuan but not more than 1

13、million yuan on the manufacturer or dealer if the manufacturer or dealer refuses to do so, and11confiscate the legal income of the manufacturer or dealer if any; and the licensing authority shall revoke the relevant license if the circumstances of violation are serious:(1) The manufacturer or dealer

14、 does not cooperate with the product quality supervision department in a defect investigation;（-）生产者、经营者不配合产 品质量监督部门缺陷调查；(2) The manufacturer fails to implement a recall in accordance with the filed recall plan.（二）生产者未按照已备案的召 回计划实施召回；(3) The manufacturer fails to notify sellers of its recall plan.（三

15、）生产者未将召回计划通报 销售者。Article 24 Where a manufacturer falls under any of the following circumstances in violation of the provisions of this Regulation, the product quality supervision department shall order it to make correction, impose a fine of not less than 1% but not more than 10% of the monetary val

16、ue of defective auto products, and confiscate the illegal income of the manufacturer if any; and the licensing authority shall revoke the relevant license if the circumstances of violation are第二十四条 生产者违反本 条例规定，有下列情形之一的， 由产品质量监督部门责令改正， 处缺陷汽车产品货值金额现以上 10%以下的罚款；有违法所得的， 并处没收违法所得；情节严重 的，由许可机关吊销有关许可：serio

17、us:(1) Failing to stop manufacturing, selling or importing defective auto products.（一）未停止生产、销售或者进 口缺陷汽车产品；(2) Withholding information on defects.（二）隐瞒缺陷情况;(3) Refusing to implement a recall as ordered.（三）经责令召回拒不召回。12Article 25 Where any person engaging in the supervision and administration of recall

18、 of defective auto products commits any of the following conduct in violation of the provisions of this Regulation, the person shall be subject to a disciplinary action in accordance with law:第二十五条违反本条例规 定，从事缺陷汽车产品召回监督 管理工作的人员有下列行为之一 的，依法给予处分：(1) Using the information, products and special equipment

19、 provided by manufacturers and dealers for purposes other than the technical detection and identification necessary for defect investigations.（一）将生产者、经营者提供的 资料、产品和专用设备用于缺陷 调查所需的技术检测和鉴定以外 的用途；(2) Divulging any trade secrets or personal information of the parties.（二）泄露当事人商业秘密或者 个人信息； Otherwise neglect

20、ing duties, practicing (三)其他玩忽职守、徇私舞 favoritism for personal gains or abusing powers. 弊、 滥用职权行为。Article 26 Whoever commits a crime by violating the provisions of this Regulation shall be subject to criminal liability.第二十六条违反本条例规 定，构成犯罪的，依法追究刑事 责任。Article 27 Where the tires not installed in auto prod

21、ucts when auto products leave factories are defective, the tire manufacturer shall be responsible for a recall. The specific measures shall be developed by the product quality supervision department of the State Council by referring to this Regulation.第二十七条汽车产品出厂 时未随车装备的轮胎存在缺陷 的，由轮胎的生产者负责召回。 具体办法由国务

22、院产品质量监督 部门参照本条例制定。13Article 28 A manufacturer shall not be exempt from any liability which it shall assume in accordance with law for implementing a recall of defective auto products in accordance with this Regulation.第二十八条生产者依照本 条例召回缺陷汽车产品，不免除 其依法应当承担的责任。Where there are any quality problems with au

23、to products other than the defects as mentioned in this Regulation, auto owners shall have the right to require the manufacturer and sellers to assume the corresponding legal liability for the repair, replacement or return of products or compensation for losses, among others, in accordance with the

24、Product Quality Law, the Consumer Rights Protection Law and other laws, administrative regulations and relevant state provisions as well as contractual provisions.汽车产品存在本条例规定的缺陷 以外的质量问题的，车主有权依 照产品质量法、消费者权益保护 法等法律、行政法规和国家有关 规定以及合同约定，要求生产 者、销售者承担修理、更换、退 货、赔偿损失等相应的法律责 任。Article 29 This Regulation shall

26、ts) which are manufactured and sold within the territory of China and the supervision and administration thereof.第二条在中国境内生产、 销售的汽车和汽车挂车（以下统 称汽车产品）的召回及其监督管 理，适用本条例。Article 3 For the purposes of this Regulation, “defects means non-compliances with state standards or industrial standards regarding prot

27、ection of personal or property safety or any other unreasonable risks to personal or property safety which exist generally in the same lot, model or type of auto products for design, manufacturing, labeling and other reasons.第三条本条例所称缺陷， 是指由于设计、制造、标识等原 因导致的在同一批次、型号或者 类别的汽车产品中普遍存在的不 符合保障人身、财产安全的国家 标准、

28、行业标准的情形或者其他 危及人身、财产安全的不合理的 危险。For the purposes of this Regulation, “recall” means that auto product manufacturers take measures to eliminate the defects in auto products already sold by them.本条例所称召回，是指汽车产品 生产者对其已售出的汽车产品采 取措施消除缺陷的活动。Article 4 The product quality supervision department of the State Co

29、uncil shall be responsible for the national supervision and administration of the recall of defective auto products.第四条国务院产品质量监 督部门负责全国缺陷汽车产品召 回的监督管理工作。国务院有关部门在各自职责范围 内负责缺陷汽车产品召回的相关 监督管理工作。第五条国务院产品质量监 督部门根据工作需要，可以委托 省、自治区、直辖市人民政府产 品质量监督部门负责缺陷汽车产 品召回监督管理的部分工作。国务院产品质量监督部门缺陷产 品召回技术机构按照国务院产品 质量监督部门的规定，承

30、担缺陷 汽车产品召回的具体技术工作。第六条任何单位和个人有 权向产品质量监督部门投诉汽车 产品可能存在的缺陷，国务院产 品质量监督部门应当以便于公众 知晓的方式向社会公布受理投诉 的电话、电子邮箱和通信地址。国务院产品质量监督部门应当建 立缺陷汽车产品召回信息管理系 统，收集汇总、分析处理有关缺Relevant departments of the State Council shall be responsible for the relevant supervision and administration of the recall of defective auto products

31、within their respective functions.Article 5 The product quality supervision department of the State Council may, as needed for work, entrust part of the supervision and administration of recall of defective auto products to the quality supervision departments of the peoples governments of provinces,

32、 autonomous regions and municipalities directly under the Central Government.The defective products recall technical agency of the product quality supervision department of the State Council shall, in accordance with the provisions issued by the product quality supervision department of the State Co

33、uncil, assume the specific technical work on the recall of defective auto products.Article 6 Any entity or individual shall have the right to file complaints on possible defects in auto products with product quality supervision departments, and the product quality supervision department of the State

34、 Council shall publish the telephone number, e-mail address and mailing address for receiving complaints in a manner facilitating public access.The product quality supervision department of the State Council shall establish a recall information management system for defectiveauto products to collect

36、s and other relevant departments shall establish a mechanism for sharing information on the manufacture, sale, import, registration, inspection, maintenance, consumer complaints and recall, among others, of auto products.Article 7 Product quality supervision departments, relevant departments and age

37、ncies, and their staff members shall not divulge any trade secrets and personal information known by them in the performance of duties prescribed in this Regulation.Article 8 A manufacturer shall recall all of its defective auto products in accordance with this Regulation; and if a manufacturer fail

38、s to implement a recall, the product quality supervision department of the State Council shall order the manufacturer to implement a recall in accordance with this Regulation.产品质量监督部门、汽车产品主 管部门、商务主管部门、海关、 公安机关交通管理部门、交通运 输主管部门等有关部门应当建立 汽车产品的生产、销售、进口、 登记检验、维修、消费者投诉、 召回等信息的共享机制。第七条产品质量监督部门 和有关部门、机构及其工作

39、人员 对履行本条例规定职责所知悉的 商业秘密和个人信息，不得泄 露。第八条对缺陷汽车产品， 生产者应当依照本条例全部召 回；生产者未实施召回的，国务 院产品质量监督部门应当依照本 条例责令其召回。本条例所称生产者，是指在中国 境内依法设立的生产汽车产品并 以其名义颁发产品合格证的企 业。For the purposes of this Regulation, “manufactured means an enterprise legally established within the territory of China, which manufactures auto products a

40、nd in whose namea certificate of product inspection is issued.An enterprise which imports auto products from outside the territory of China to sell within the territory of China shall be deemed a manufacturer as mentioned in the preceding paragraph.从中国境外进口汽车产品到境内 销售的企业，视为前款所称的生 产者。Article 9 Manufact

41、urers shall establish and preserve records of information on the design, manufacturing, labeling and inspection, among others, of auto products, as well as records on initial purchasers of auto products for a period of not less than 10 years.第九条生产者应当建立并 保存汽车产品设计、制造、标 识、检验等方面的信息记录以及 汽车产品初次销售的车主信息记 录，

42、保存期不得少于10年。Article 10 A manufacturer shall file the following information with the product quality supervision department of the State Council for recordation:第十条 生产者应当将下列 信息报国务院产品质量监督部门 备案：(1) Basic information on the manufacturer.（一）生产者基本信息;(2) Information on the technical parameters of auto produ

43、cts and the initial purchasers of auto products.（二）汽车产品技术参数和汽车 产品初次销售的车主信息；(3) Information on repair, replacement or return of auto products for malfunctions of auto products which endanger personal or property safety.（三）因汽车产品存在危及人 身、财产安全的故障而发生修 理、更换、退货的信息；(4) Information on recall of auto products

44、outside the territory of China.（四）汽车产品在中国境外实施 召回的信息；（五）国务院产品质量监督部门 要求备案的其他信息。第十一条销售、租赁、维 修汽车产品的经营者（以下统称 经营者）应当按照国务院产品质 量监督部门的规定建立并保存汽 车产品相关信息记录，保存期不 得少于5年。经营者获知汽车产品存在缺陷 的，应当立即停止销售、租赁、 使用缺陷汽车产品，并协助生产 者实施召回。经营者应当向国务院产品质量监 督部门报告和向生产者通报所获 知的汽车产品可能存在缺陷的相 关信息。第十二条生产者获知汽车 产品可能存在缺陷的，应当立即 组织调查分析，并如实向国务院 产品质量

45、监督部门报告调查分析 结果。(5) Other information required by the product quality supervision department of the State Council for recordation.Article 11 Businesses engaging in the selling, leasing or repair of auto products (hereinafter collectively referred to as the “dealers) shall, in accordance with the provi

46、sions of the product quality supervision department of the State Council, establish and preserve records of relevant auto product information for a period of not less than five years.When a dealer becomes aware of any defects in auto products, it shall immediately stop selling, leasing or using defe

47、ctive auto products and assist a manufacturer in implementing a recall.A dealer shall report to the product quality supervision department of the State Council and notify the manufacturer of relevant information on possible defects in auto products of which it becomes aware.Article 12 When a manufac

48、turer becomes aware of any possible defects in its auto products, it shall immediately organize investigation and analysis and truthfully report the results of investigation and analysis to the product quality supervision department of the State Council.When a manufacturer confirms that there is a defect in its auto products, it shall immediate
