3、解密后也遵守此规定.签 名：Ah气导师签名：法曰期 ： 丨 十 年 月 孓 日随着城镇化进程的加快，城镇土地利用趋于饱和，城镇化的用地需求不断地转向农 村集体土地。农村集体土地的价值日益提高，使得部分素质不高的“村官”走上了涉土 腐败的道路，大发土地财。不断曝光的腐败案件，不断刷新的腐败金额，让人瞠目结舌， “村官”涉土腐败俨然成为了“村官”腐败的高发区。“村官”涉土腐败严重侵害农民 和集体的利益，破坏党和政府的形象，人民对此深恶痛绝。因此，在当今反腐倡廉建设 的大背景下，坚持“老虎”、“苍蝇”一起打，打击“村官”涉土腐败迫在眉睫。我国农村实行村民自治制度，“村官”不属于国家行政人员，“村官”

4、腐败相较于其 他国家工作人员腐败具有特殊性。村民自治弱化，权力监督缺失是“村官”涉土腐败现 象发生的重要原因。针对“村官”腐败的特殊性，本文立足于村民自治的社会大背景， 对“村官”涉土腐败现象进行分析，进而探求“村官”涉土腐败产生的原因及疗救的对 策。论文首先对“村官”、“村官”腐败、“村官”涉土腐败内涵进行了界定，同时对村 民自治的内涵及其监督机制进行了阐述，指出“村官”涉土腐败就是“村官”在涉及土 地产权流转、土地开发利用的过程中滥用权力，谋取私利的违纪违法行为。其次，通过走访了解和案例分析，归纳总结目前“村官”涉土腐败的类型、特点和 危害。“村官”涉土腐败主要表现有贪污截留征地款、无视农

5、民意愿流转土地、宅基地 分配徇私利己、违法转让集体土地以及基础设施建设中饱私囊。其中，征地拆迀领域为 重灾区，犯罪手段多样，涉案金额不断上升，群体化趋向显著，隐蔽性强为“村官”涉 土腐败现象的主要特点。这些腐败现象伤害了农民的利益，破坏社会的和谐稳定。再次，主要从村民自治制度角度分析“村官”涉土腐败的成因。“村官”涉土腐败 现象的产生是由多种因素造成的，主要包括“村官”思想政治素质不适应，农村集体土 地所有权制度不完备、“村官”选举偏离民意，农村村务民主管理不规范、村民自治民 主监督乏力、上级监督失位、司法监督不力等方面。最后，针对上述“村官”涉土腐败的原因，提出相应的对策。主要对策有发挥思想

6、 政治教育反腐倡廉的功能，完善集体土地所有权制度、完善集体土地征收补偿制度、严 格规范“村官”选举制度、完善村民自治民主管理，强化村民民主监督、健全司法机关 “村官”涉土腐败案件处理机制。关键词：村民自治；“村官”；涉土腐败AbstractAbstractWith the rapid development speed of urbanization, the use of urban land tends to saturation and the demand for urbanization land constantly turns to rural collective land.

7、Meanwhile, the value of rural collective land is gradually increasing and village officials who do not have high quality begin to seek the personal gain from the collective land and step on the corruption road in order to gain much money from the land. It makes people stunning that the number of lan

8、d corruption cases is continuous rising high and the amount of corruption sum is constantly refreshed and village officials land corruption has apparently become a high incidence area. Village officials land corruption seriously violates the benefits of villagers and collective groups and undermines

9、 the image of the party and the government? which makes people disgusted about this corruption. Therefore, fighting with the villager officials land corruption is imminent and government should insist on the policy “fight the Tiger and Flies together” under the background of anti-corruption. Village

10、 officials do not belong to the national executive staffs because our country carries out the villagers autonomy regime. Thus, village officials corruption has something special when compared with other national executive staffs. The weakness of villagers autonomy and loss of power supervision becom

11、e the main reason of land corruption. In terms of the specialization of villagers corruption, this thesis will summarize the phenomenon of villager officials land corruption, seek the causes of land corruption and try to find out countermeasures in the perspective of villagers autonomy. This thesis

12、firstly gives the definition of village official，village officials corruption and village officials land corruption, states the embodiment of villagers autonomy and supervision system and points out that land corruption are actually illegal behaviors which include illegal land retention, illegal lan

13、d development. Secondly, this thesis summarizes the kinds, characteristics and hazards of land corruption through visiting experiences and case analysis. Village officials land corruption main reflects in the aspects of retention of the land requisition, ignoring villagers wish about transferring la

14、nd gaining the benefit from homestead allocation and transferring collective land and infrastructure illegally. Among these aspects, the removal districts are the heaviest corruption district with the characteristics of various criminal devices, increasing corruption money, tendency of group corrupt

15、ion and high concealment. These corruption phenomena harm the benefits of villagers and destroy the harmony of society.Besides, this thesis mainly analyzes the causes of land corruption in the perspective of villager autonomy system. Villagers land corruption phenomena are caused by many factors whi

16、ch include inadaptability of village officer political quality, incomplete rural collective land ownership system, deviation of village election from public opinion, nonstandard rural village affairs democratic management，weakness of autonomy of villagers democratic supervision, lack of supervision

17、and superior judicial supervision etc. Finally, this thesis comes up with corresponding solutions in terms of the villagers land corruption which include carrying out anti-corruption function of ideological and politicalAbstracteducation, promoting collective land ownership system, promoting collect
