5、cember 29, 2021 and effective as of February 15, 2022)Article 24 (Requirements for Demonstration Application)第二十四条（示范应用要 求）In the process of demonstration application, the vehicles may carry relevant persons or goods in accordance with provisions, but shall not exceed the rated passengers and ratifi

6、ed load capacity of the vehicle, shall not carry dangerous goods, and shall not charge service objects.在示范应用过程中，车辆可以按 照规定搭载相关人员或者货物， 但不得超出额定乘员和核定载质 量，不得搭载危险货物，不得向 服务对象收取费用。The demonstration application subject shall express the possible risks to the service object and take necessary security measure

7、s.示范应用主体应当向服务对象明 示可能存在的风险，并采取必要 的安全措施。Chapter IV Demonstration Operation第四章示范运营Article 25 (Definition of Demonstration Operation)第二十五条（示范运营的 定义）智能网联汽车示范运营，是指在 本市公路（包括高速公路）、城 市道路（包括城市快速路）以及 特定区域范围内用于社会机动车 辆通行的各类道路的指定路段， 对智能网联汽车开展载人、载货 或者特种作业的商业试运营活 动。Article 26 (Demonstration Operation Procedures)第二十

8、六条（示范运营程 序）Demonstration operation of intelligent connected vehicles refers to commercial pilot operation activities of carrying people, cargoes or special operations for intelligent connected vehicles on designated sections of municipal highways (including expressways), urban roads (including urban

9、 expressways) and all kinds of roads used for social motor vehicles within specific areas.具备开展智能网联汽车示范运营 相关技术能力，能够独立承当相 应责任的单位（以下简称示范运 营主体），可以按照有关规定， 开展智能网联汽车示范运营活 动。开展示范运营的车辆应当经过示Units (hereinafter referred to as demonstration operation subjects11) that have relevant technical abilities to carry ou

10、t demonstration operation of intelligent connected vehicles and are able to independently assume corresponding responsibilities may carry out demonstration operation activities of intelligent connected vehicles in accordance with relevant provisions.Vehicles for demonstration operation shall go thro

12、he demonstration operation subject shall submit the demonstration operation plan and safety self-statement on the demonstration operation of intelligent connected vehicles. The demonstration operation plan shall set forth security measures, relevant risk analysis and counter measures.Article 27 （Con

13、firmation of Safety Self-statement on 第二十七条（示范运营安Demonstration Operation）全性自我声明确实认）市交通部门应当组织有关部门、 第三方机构和专家，对示范运营 主体提交的智能网联汽车示范运 营安全性自我声明进行确认。The municipal transportation department shall organize relevant departments, third-party institutions and experts to confirm the safety self-statement on demon

14、stration operation of intelligent connected vehicles submitted by the demonstration operation subject.Article 28 （Eligibility for Demonstration Operation）第二十八条（示范运营条 件）Those that carry out demonstration operation activities of intelligent connected vehicles shall meet the following conditions:开展智能网联

15、汽车示范运营活 动，应当具备以下条件：1. have corresponding road transport business qualifications, or cooperate with units with corresponding road transport business qualifications;（一）具备相应的道路运输经营 资质，或者与具备相应道路运输 经营资质的单位合作；2. have vehicles that have passed the test and suitable for the business operation;（二）具备与经营业务相适应并

16、 经检测合格的车辆；3. have relatively fixed operation routes and operation time （三）具有相对固定的运营线路 intervals;及运营时段；4. the test and safety personnel and drivers meeting corresponding road transport qualification; andthe （四）测试安全员、驾驶人符合相应的道路运输从业条件；5. have a sound production safety management system.（五）具有健全的安全生产管理11

17、制度。Article 29 (Requirements for Demonstration Operation)第二十九条（示范运营要 求）In the course of demonstration operation, the vehicle may carry relevant persons or cargos in accordance with provisions, but it shall not exceed the rated passengers and ratified load capacity of the vehicle, and it shall not car

18、ry dangerous goods.在示范运营过程中，车辆可以按 照规定搭载相关人员或者货物， 但不得超出车辆的额定乘员和核 定载质量，不得搭载危险货物。The demonstration operation subject shall not engage in illegal road transport business activities, and shall make clear the possible risks to the service objects and take necessary safety measures.示范运营主体不得从事非法道路 运输经营活动，并应

19、当向服务对 象明示可能存在的风险，采取必 要的安全措施。Article 30 (Charging Administration)第三十条（收费管理）For carrying out demonstration operation, a certain amount of fees may be appropriately charged. Charging rates shall be specified in the demonstration operation plan; if fees are collected from unspecified objects, the standa

20、rds for fees shall be released to the public.开展示范运营，可以适当收取一 定费用。收费标准应当在示范运 营方案里载明；面向不特定对象 收费的，应当向社会公示收费标 准。Chapter V Commercial Operation第五章商业化运营Article 31 (Definition of Commercial Operation)第三十一条（商业化运营 的定义）智能网联汽车商业化运营，是指 依法取得道路运输经营资质，利 用智能网联汽车从事道路运输经 营活动。第三十二条 （车辆要求）Commercial operation of intelli

21、gent connected vehicles refers to the use of intelligent connected vehicles to engage in road transport business activities after obtaining road transport operation qualification according to law.Article 32 (Requirements for Vehicles)12Intelligent connected vehicles engaged in road transport 从事道路运输经

22、营活动的智能网 business activities shall meet the following conditions:联汽车应当符合以下条件：（一）获得产品准入或者具备同 等条件的产品认定；2. It has passed the test and is suitable for the business; And（二）与经营业务相适应，并经 检测合格；3. It is registered by the public security department, with the vehicle license plate, driving license and other regi

23、stration certificates in place.（三）经公安部门注册登记，取 得车辆号牌、行驶证等登记凭 证。Article 33 (Personnel Requirements)第三十三条（人员要求）Drivers of intelligent connected vehicles engaged in road transport business activities shall meet the corresponding road transport business qualifications and be able to master the automatic

24、driving system of intelligent connected vehicles.从事道路运输经营活动的智能网 联汽车的驾驶人应当符合相应的 道路运输从业条件，能够熟练掌 握智能网联汽车自动驾驶系统。Article 34 (Total Volume Control)第三十四条（总量调控）This Municipality shall regulate and control the commercial operation of intelligent connected vehicles according to the economic and social develop

25、ment and road traffic conditions.本市根据经济社会开展、道路交 通状况，对智能网联汽车商业化 运营进行调控。The municipal transportation department may, in accordance with the actual needs, exercise total regulation and control over the development scale, quantity and models of intelligent connected vehicles engaged in public transport,

26、 rental, freight transport and other businesses.市交通部门可以根据实际需要， 对从事公交、出租、货运等业务 的智能网联汽车的开展规模、数 量和车型等实行总量调控。Chapter VI Management of Road Traffic Safety第六章道路交通安全管理Article 35 (Designating Road Sections and Areas)第三十五条 （划定路段、 区域）131. Obtaining product access or having product accreditation with the same

27、conditions;The municipal transportation department shall, together with the municipal departments of public security, economic informatization, demarcate sections and areas for the test and application of intelligent connected vehicles in accordance with the test and application requirements and bas

28、ic road conditions, gradually expand the scope of sections and areas, support the opening of full specific areas, and enrich the test and application scenarios.市交通部门会同市公安、经济信 息化等部门根据智能网联汽车测 试与应用需要和道路基础条件， 划定智能网联汽车测试与应用路 段、区域，并逐步扩大路段、区 域范围，支持特定区域全域开 放，丰富测试与应用场景。智能网联汽车测试与应用路段、 区域应当向社会公布，并在路 段、区域内以及周边设

29、置相应标 识和安全提示信息。The road sections and areas for testing and application of intelligent connected vehicles shall be released to the public, and corresponding signs and safety warning information shall be set up within and around the road sections and areas.Article 36 (Test Safety Officer or Driver)第三十六

30、条（测试安全员 或者驾驶人）When testing and application activities of intelligent connected vehicles are carried out, corresponding test safety officers or drivers shall be assigned according to the requirements of relevant technical standards.开展智能网联汽车测试与应用活 动，应当根据有关技术标准要 求，配备相应的测试安全员或者 驾驶人。The test safety offic

31、er or driver shall always monitor the running state of the vehicle and the surrounding environment, and shall take corresponding measures in time when the vehicle is found to be in a state unsuitable for automatic driving or the system prompts the need for manual intervention.测试安全员或者驾驶人应当始终 监控车辆运行状态

32、及周围环境， 发现车辆处于不适合自动驾驶的 状态或者系统提示需要人工干预 时，应当及时采取相应措施。The testing and application units of intelligent connected vehicles shall regularly train test safety personnel or drivers with professional knowledge of automatic driving system and emergency handling abilities.智能网联汽车测试与应用单位应 当定期对测试安全员或者驾驶人 开展自动驾驶系统

33、专业知识、应 急处置能力等方面的培训。Article 37 (Applying for a License Plate)第三十七条（申领号牌）After the registration in the public security department, the intelligent and connected vehicle can run on the road.智能网联汽车经公安部门登记 后，方可上道路行驶。Units that carry out road testing, demonstration application and demonstration operation

34、of intelligent connected vehicles shall apply to public security departments for temporary driving开展智能网联汽车道路测试、示 范应用、示范运营的单位，凭经14相关主管部门确认的安全性自我 声明以及车辆登记需要的其他材 料，向公安部门申领临时行驶车 号牌。Article 38 (Rules of Passage)第三十八条（通行规那么）When intelligent connected vehicles run on roads, they shall abide by the provisio

35、ns of road traffic safety laws and rules.智能网联汽车上道路行驶，应当 遵守道路交通安全法律、法规的 规定。For intelligent connected vehicles carrying out road test, demonstration application and demonstration operation, relevant activities shall be carried out in the road sections and areas specified in the self- statement on the

36、safety; where there is a need to drive outside the aforesaid road section or area for transfer reasons, the relevant provisions of the State and this Municipality shall be followed.开展道路测试、示范应用、示范 运营的智能网联汽车，应当在安 全性自我声明载明的测试与应用 路段、区域开展相关活动；因转 场等原因需要在上述路段、区域 以外行驶的，按照国家和本市有 关规定执行。Intelligent connected v

37、ehicles shall, in accordance with relevant provisions, be equipped with prominent logo patterns.智能网联汽车应当按照有关规 定，设置显著的标志图案。Article 39 (Report and Inspection)第三十九条（报告与检 查）Units that carry out the road test, demonstration application and demonstration operation of intelligent connected vehicles shall,

38、in accordance with relevant provisions, install monitoring devices, connect the relevant test and application data to the designated data platform, regularly submit the test or application report to the municipal economic informatization department, and accept the compliance inspection of a third- p

39、arty institution.开展智能网联汽车道路测试、示 范应用、示范运营的单位应当按 照有关规定，安装监控装置，将 相关测试、应用数据接入指定的 数据平台，并定期向市经济信息 化部门提交测试或者应用情况报 告，接受第三方机构的合规性检 查。The municipal economic informatization department shallregularly publicize the status of testing and application of市经济信息化部门应当定期向社 会公布本市智能网联汽车测试与intelligent connected vehicles i

41、monstration operation of intelligent connected vehicles shall, in accordance with relevant provisions, take out compulsory motor vehicle traffic accident liability insurance, and insure commercial insurance of a certain amount or provide a letter of guarantee of the corresponding amount.Insurance co

42、mpanies are encouraged to develop insurance products adapted to the characteristics of intelligent connected vehicles.开展智能网联汽车道路测试、示 范应用、示范运营的单位应当按 照有关规定，投保机动车交通事 故责任强制保险，并投保一定金额的商业保险或者提供相应金额 的保函。鼓励保险公司开发适应智能网联 汽车特点的保险产品。鼓励智能网联汽车相关社会团 体、企业等联合设立社会风险基 金，对因智能网联汽车遭受人 身、财产损失的受害者，因责任 无法认定等原因不能及时得到赔 偿时，先予补

43、偿。Article 41 (Troubleshooting)第四十一条（故障处置）Social organizations and enterprises related to intelligent connected vehicles are encouraged to jointly set up social risk funds to compensate victims who suffer personal and property losses due to intelligent connected vehicles in case they are unlikely to

44、get timely compensation due to the reasons such as inability to identify the responsibility.智能网联汽车在测试与应用过程 中发生故障的，测试安全员或者 驾驶人应当及时采取措施，减速 或者安全停靠，保障车辆处于安 全状态。开展智能网联汽车道路测试、示 范应用、示范运营的单位应当及 时将相关故障信息传输至指定的 数据平台，并保存至少一年。Article 42 (Accidents Handling)第四十二条（事故处理）If a fault occurs during the testing and app

45、lication of an intelligent connected vehicle, the test safety officer or driver shall take timely measures to slow down the vehicle or park it safely to ensure the vehicle is in a safe state.Units that carry out road test, demonstration application and demonstration operation of intelligent connecte

46、d vehicles shall timely transmit relevant fault information to the designated data platform and keep it for at least one year.智能网联汽车发生交通事故的， 测试安全员或者驾驶人应当立即 启动应急机制，在保证安全的前 提下立即停车，保护现场；造成 人身伤亡的，应当立即抢救受伤If a traffic accident occurs to an intelligent connected vehicle, the test safety officer or driver

47、shall immediately start the emergency mechanism, stop the vehicle immediately under the premise of ensuring safety, and protect the scene; if personal injury or death is caused, the injured shall be rescued16immediately and the call shall be made to the police.人员并报警。开展智能网联汽车道路测试、示 范应用、示范运营的单位应当对 事故过

48、程进行技术分析并形成事 故分析报告。相关事故过程信息 和事故分析报告应当及时报告市 公安部门，并保存至少一年。Article 43 (Identification and Assumption of Liabilities)第四十三条（责任认定与 承当）Units that carry out road testing, demonstration application and demonstration operation of intelligent connected vehicles shall conduct technical analysis of the accident process and formulate accident analysis reports.
