19、过各种不同的保险条款规定的。我国货物运输保险险别，按照能否单独投保，可分为基本险和附加险基本险和附加险基本险和附加险基本险和附加险两类。基本险可以单独投保，而附加险不能单独投保，只有在投保基本险的基础上才能加保附加险。1、基本险别中国人民保险公司所规定的基本险别包括平平安险、水渍险和一切险安险、水渍险和一切险。基本险(1)平安险平安险在投保平安险的情况下，保险公司对由自然灾害自然灾害所造成所造成的部的部分损失，不负责赔偿分损失，不负责赔偿，而由于因意外事故所造成的部分损失则要负赔偿责任。(2)水渍险投保水渍险后，保险公司除担负上述平安险的各项责任外，还对被保险货物如由于恶劣气候、雷电、海啸、地

20、震、洪水等自然灾害所造成的部分损失负赔偿责任。(3)一切险一切险的责任范围除包括上列“平安险”“水渍险”外，还包括货物在运输过程中，因各种外来原因所造成的保险货物的全损或部分损失，但不包括由于运输延迟运输延迟、货物本身特性所造成的损失，物价下跌的损失，以及战争和罢工所造成的损失等.平安险（Free from Particular Average，简称F.P.A.）=Institute C Clause这一名称在我国保险行业中沿用甚久，其英文原意是指单独海损不负责赔偿。根据国际保险界对单独海损的解释，它是指保险标的物在海上运输途中遭受保险范围内的风险直接造成的船舶或货物的灭失或损害。因此，平安险

21、的原来保障范围只赔全部损失。但在长期实践的过程中对平安险的责任范围进行了补充和修订，当前平安险的责任范围已经超出只赔全损的限制。Average:lossundermarineinsuranceGeneral:bothcargoandvessel(e.g.throwinggoodsoverboardortuggingservice)Particular:cargoitselfF.P.A.usedmainlyinbulktrade平安险责任范围平安险责任范围1、被保险货物在运输途中由于恶劣气候、雷电、海啸、地震、洪水自然灾害造成整批货物的全部损失或推定全损。当被保险人要求赔付推定全损时，须将受损货

22、物及其权利委付给保险公司。被保险货物用驳船运往或运离海轮的，每一驳船所装的货物可视作一个整批。推定全损是指被保险货物的实际全损已经不可避免，或受损货物残值，如果加上施救、整理、修复、续运至目的地的费用之和超过其抵达目的地的价值时，视为已经全损。2、由于运输工具遭搁浅、触礁、沉没、互撞，与流域一其他物体碰撞以及失火、爆炸等意外事故造成被保险货物的部分损失。3、只要运输工具曾经发生搁浅、触礁、沉没、焚毁等意外事故，不论这个意外事故发生之前或者以后曾在海上遭恶劣气候、雷电、海啸等自然灾害所造成的被保险货物的部分损失。平安险责任范围平安险责任范围4、在装卸转船过程中，被保险货物一件或数件落海所造成的全

23、部损失或部分损失。5、运输工具遭自然灾害或意外事故，在避难港卸货所引起被保险货物的全部损失或部分损失。6、运输工具遭自然或灾害或意外事故，需要在中途的港口或者在避难港口停靠，因而引起的卸货、装货、存仓以及运送货物所产生的特别费用。7、发生共同海损所引起的牺牲、公摊费和救助费用。8、发生了保险责任范围内的危险，被保险人对货物采取抢求、防止或少损失的各种措施，因而产生合理施救费用。但是保险公司承担费用的限额不能超过这批被救货物的保险金额。施救费用可以在赔款金额以外的一个保险金额限度内承担。水渍险=Institute B Clause的责任范围除了包括上列平安险的各项责任外，还负责被保险货物在运输过

24、程中由于恶劣气候、雷电、海啸、地震、洪水等自然灾害所造成的部分损失（all risks）=Institute A Clause一切险的责任范围除包括上列水渍险的所有责任外，还包括货物在运输过程中，因一般外来风险所造成保险货物的损失。如被窃、雨淋、渗漏、碰损、破碎、串味、受潮受热、钩损等。ICCAcoverstheft,loss,breakage,leakage不论全损或部分损失除对某些运输途耗的货物，经保险公司与被保险人双约定在保险单上载明的免赔率外，保险公司都给予赔偿。附加险附加险可以分为一般附加险、特别附加险、特殊附加险1、一般附加险(Generaladditionalrisk)。一般附加

25、险包括偷窃提货不着险、淡水雨淋险、短量险、混杂玷污险、渗漏险、碰损破碎险、串味险、受潮受热险、钩损险、包装破裂险、锈损险等11种险别。它们包括在一切险范围内。1）偷窃提货不着险(Theft,PilferageandNon-delivery简称TPND)：保险有效期内，保险货物被偷走或窃走，以及货物运抵目的地以后，整件未交的损失，由保险公司负责赔偿。2）淡水雨淋险(Freshwater/orraindamage)：货物在运输中，由于淡水、雨水以至雪溶所造成的损失，保险公司都应负责赔偿。淡水包括船上淡水舱、水管漏水以及汗等。附加险3）短量险(Shortage)：负责保险货物数量短少和重量的损失。通

26、常包装货物的短少，保险公司必须要查清外装包是否发生异常现象，如破口、破袋、扯缝等，如属散装货物，往生育装船和卸重量之间的差额作为计算短量的依据。4）混杂玷污险(Intermixtureandcontamination)：保险货物在运输过程中，混进了杂质所造成的损换。例如矿石等混进了泥士、草屑等因而使质量受到影响。此外保险货物因为和其他物质接触而被沾污，例如布匹、纸第、食物、服装等被油类或带色的物质污染因而引起的经济损失。5）渗漏险(Leakage):流质、半流质的液体物质同和油类物质，在运输地程中因为容器损坏而引起的渗漏损换。如以液体装存的湿肠衣，因为液体渗漏而使肠发生腐烂。变质等损失，均由保

27、险公司负责赔偿。6）碰损破碎险（Clashandheating)：碰损主要是对金属、木质等货物来说的，破碎则主要是对易碎性物质来说的。前者是指在运输途中，因为受到震动、颠簸、挤压而造成货物本身的损失；后者是在运输途中由于装卸野蛮、粗鲁、运输工具的颠震造成货物本身的破裂、断碎的损失。附加险7）串味险：例如，茶叶、香料、药材等在运输途中受到一起堆储的皮第、樟脑等异味的影响使品质受到损失。8）受热受潮险(Taintofodour)：例如，船舶在航行途行途中，由于气温骤变，或者因为船上通风设备失灵等使舱内水气凝结、发潮、发热引起货物的损失。9）钩损险(Hookdamage)：保险货物在装卸过程中因为使

28、用手钩、吊钩等工具所造成的损失，例如粮食包装袋因吊钩钩坏而造成粮食外漏所造成的损失，保险公同在承保该险的史下，应予赔偿。10）包装破裂险（Breakageofpacking)：因为包装破裂造成物资的短少、沾污等损失。此外，对于因保险货物运输过程中续运安全需要而产生的候补包装、调换包装所支付的费用，保险公司也应负责。附加险11）锈损险：保险公司负责保险货物在运输过程中因为生锈造成的损失。不过这种生锈必须在保险期内发生，如原装时就已生锈，保险公司不负责任。特别附加险特别附加险包括交货不到险、进口关税险、舱面险、拒收险、黄曲霉素险、出口到港澳存舱火险等6种。黄曲霉素险对被保险货物因所含黄曲霉素超过进

29、口国的限制标准被拒绝进口，没收或强制改变用途而遭受的损失负责赔偿。货物不到险对不论由于任何原因，从被保险货物装上船舶时开始，不能在预定抵在预定抵达目的地的日期起6个月内交货的，负责按全损赔偿。舱面险特别附加险对被保险货物存放舱面时，除按保险单所载条款外，还包括被抛弃或被风浪冲击落水在内的损失。进口关税险当被保险货物遭受保险责任范围以内的损失，而被保险人仍须安以完好货物价值通关时，保险公司对损失部分货物的进口关税负责赔偿。拒收险对被保险货物在进口港被进口国的政府或有关当局拒绝进口或没收，按货物的保险价值负责赔偿特殊附加险特殊附加险属于附加险类，但不属于一切险的范围之内。战争险(Institute

30、WarClause)战争险负责赔偿：直接由于战争、类似战争行为和敌对行为、武装行为或海盗行为所致的损失；以及由此所引起的捕获拘留、扣留、禁止、扣押所造成的损失；各种常规武器(包括水雷、鱼雷、炸弹)所致的损失，以及由上述责任范围而引起的共同海损的牺牲，分摊和救助费用。不负责赔偿：使用原子或热核武器造成的损失。战争险的保险责任起讫是以水上危险为限，即自货物在起运港装上海轮或驳船时开始，直到目的港卸离海轮或驳船为止。如果不卸离海轮或驳船，则从海轮到达目的港的当日午夜起算满15天，保险责任自行终止。如在中途港转船，不论货物是否在当地卸货，保险责任以海轮到达该港或卸货地点的当日午夜起算满15天为止，再装

31、上续运海轮时恢复有效。特殊附加险罢工险(InstituteStrikes,RiotsandCivilCommotionClause)罢工险赔偿的范围：被保险货物由于罢工工人被迫停工或参加工潮暴动等因人员的行动或任何人的恶意行为所造成的直接损失和上述行动或不行为所引起的共同海损的牺牲，分摊和救助费用负责。不赔偿的范围：罢工期间由于劳动力短缺或不能使用劳动力所造成的被保险货物的损失；因罢工引起的动力或燃料缺乏使冷藏机停止工作所致的冷藏货物的损失；无劳动力搬运货物；使货物堆积在码头淋湿受损。险别FreefromParticularAverage（F.P.A.）平安险WithParticularAve
