4、会公共 秩序。本文通过调查发现，目前太原市重新违法犯罪的归正人员年龄结 构呈现年轻化、低龄化趋势，文化水平程度普遍偏低，大多没有工作或 没有经济来源，犯罪类型以吸毒、侵害公私财产及公民人身权利为主， 而究其原因，与法律控制不力、社会建设不足和归正人员自身原因密切 相关。根据当前我国依法治国的战略部署，按照宪法指引下的法制与社 会的发展原则，太原市要创设归正人员重新违法犯罪控制的法制化、社 会化以及多元协同理念，从推进归正人员安置帮教的法律制度建设、贯 彻落实归正人员分类管理的实践制度、严格规范归正人员走向社会的衔 接制度等方面，来加强法律控制，将归正人员防控机制纳入法治框架； 以社会回归为主线

5、，拓展安置渠道，强化科学管理，探索引入心理矫治， 发挥信息网络在归正人员安置帮教中的效能，努力构建归正人员社会控 制的多方共建机制，以此来推进社会建设，帮助归正人员及早并真正溶 入社会，防控其重新走上违法犯罪道路。 关键词：归正人员；重新违法犯罪；法律控制；社会建设 _ABSTRACT Reformed staff of the public as a special group, their punishment shall be given in the same time, in accordance with the Constitution and our laws, giving

24、世界性的、复杂性的社会问题和法律问题，也是 专家学者和各国政府普遍关注的一个司法行政问题和公共管理问题。卢梭在其社 会契约论中指出： “人是生而自由平等的，这是天赋的权利” 。归正人员作为社会 公众的一个组成部分，其在重新走上社会道路过程中的一系列人权保障，如生存权 和发展权等，都必须得到切实地保障，这也是防止归正人员重新违法犯罪的重要法 理基础。 在党的十八届四中全会上，我国提出了依法治国的战略部署，明确了宪法的根 本指导地位和法律在社会建设中的重要作用。归正人员作为我国社会公众的一个相 对特殊的群体，在依法给予其惩处的同时，理应要按照宪法和法律规定，赋予其应 有的人权属性，防止其再次走上违

25、法犯罪的道路，对社会秩序造成进一步危害。 目前，我国上层建筑对归正人员及其重新违法犯罪问题高度重视，采取一系列 法律、社会手段，努力建立起切实、有效的防控机制，帮助归正人员真正改过自新， 走上正常人的生活轨迹。但同时不可忽视的是，随着我国社会经济不断发展，归正 人员由于种种原因，依然存在重新进行违法犯罪的情况，尽管所占比例较小，但已 成为影响我国社会安全与稳定的重要因素。 以本文所探讨的太原市为例，截止2014年底，太原市在册管理的归正人员5725 人，实现了重点对象接回率达100%、一般帮教对象接回率达87%、帮教率达98%、安 置率92%的管理目标，但与此同时，太原市归正人员重新违法犯罪率

26、为2.07%，对当 地的社会秩序造成了一定的威胁和影响，更为重要的是，归正人员的重新违法犯罪， 也引发了社会公众对我国司法能力的质疑，以及对法治社会的担忧。 纵观全国，归正人员重新违法犯罪现状同样不容乐观，归正人员重新违法犯罪 所显现的特点、态势及巨大的社会危害性，需要引起全社会的高度重视。在当前依 法治国形势下，采取切实有效的预防和惩治措施，杜绝或减少归正人员的重新犯罪， 将这一群体纳入到我国普通公民的正常法律规范中，是当前我国社会建设和法制进 程的重要课题和首要任务。基于此，本文以太原市归正人员重新违法犯罪防控机制 问题为切入点，采取社会调查和问卷调查的方式，对归正人员这一特殊群体进行研 究，在剖析现状的同时，提出相应的因应对策，以此促进我国法治社会的深入发展。 （二）相关概念分析 _
