3、由由于国家家标准是是我国的的标准体体系中效效力层次次最高、影影响最广广、最体体现社会会公共利利益的一一类标准准，所以以一旦在在国家技技术标准准的制定定和实施施中出现现这些专专利纠纷纷，就可可能会给给国家安安全、人人民生命命健康以以及社会会公共利利益带来来巨大的的不利影影响。要要妥善地地解决国国家技术术标准与与专利权权之间的的冲突必必须将我我国标准准体系的的改进与与专利制制度的完完善相结结合，必必须综合合运用法法律、行行政法规规、行政政规章以以及相关关司法解解释等法法律渊源源进行全全面合理理地规制制。有鉴于此此，本报报告拟就就国家技技术标准准与专利利权的关关系进行行研究，分分析在国国家技术术标准

4、的的制定与与执行时时可能出出现的专专利纠纷纷，将国国外先进进经验与与我国实实际国情情相结合合，研究究解决这这些专利利纠纷的的途径，为为我国相相关立法法提出合合理的建建议和意意见。需需要说明明的一点点是，本本课题立立项的时时候拟定定的题目目为“国家强强制性技技术标准准与专利利权关系系”，经过过征询有有关专家家的意见见，认为为该表述述不够准准确。在在我国，标标准按照照标准效效力等级级可分为为国家标标准、行行业标准准、地方方标准和和企业标标准；按按照标准准强制效效力的有有无可以以划分为为强制性性标准和和推荐性性标准。因因此在我我国，国国家标准准分为强强制性国国家标准准和推荐荐性国家家标准，而而强制性

5、性标准分分为强制制性国家家标准和和强制性性行业标标准。如如上所述述的标准准体系与与国外发发达国家家的标准准体系具具有较大大的差异异。考虑虑到本课课题立项项的初衷衷和适应应我国标标准化体体系改革革的需要要，本报报告仅就就国家标标准进行行研究。本报告分分由总报报告及其其附件以以及十个个分报告告组成。总总报告分分为以下下四部分分。第一部分分“技术标标准与专专利权的的结合”主要就就国家技技术标准准与专利利权的关关系进行行深入研研究分析析。总报报告从技技术标准准与专利利权结合合的原因因分析入入手，得得出三点点结论：（1）专专利权与与标准的的结合是是社会科科学技术术、经济济活动发发展的必必然结果果，特别别

6、在高科科技领域域几乎是是无可避避免的；（2）在在研究技技术标准准与专利利权的关关系时需需要考虑虑到三方方主体的的利益，一一是专利利权人的的合法权权益，二二是标准准化组织织制定和和推行标标准的权权利，三三是作为为标准使使用者的的社会公公众的权权益。忽忽略任何何一方的的权益都都是不可可取的；（3）标标准化组组织需要要制定相相应的专专利权政政策，以以求对专专利权人人行使标标准所涉涉及的专专利权的的行为进进行正确确的规制制和引导导，但是是基于标标准化组组织自身身的性质质，标准准化组织织本身不不能完全全承担有有效约束束和引导导专利权权人的职职责，而而是需要要与专利利的行政政管理机机关相互互合作，避避免出

7、现现全盘否否定专利利权人利利益或者者为维护护专利权权人的利利益而妨妨碍技术术标准正正常制定定与实施施的情况况。在此此基础上上，报告告分析了了专利权权与技术术标准结结合的方方式，并并总结了了技术标标准与专专利权结结合后容容易产生生的问题题。报告告认为就就目前而而言，技技术标准准与专利利权结合合后容易易产生的的法律问问题主要要包括：1.出现在在技术标标准中的的专利技技术是没没有获得得专利权权人许可可的，导导致标准准使用人人无可适适从；22.专利权权人拒绝绝许可导导致技术术标准无无法出台台；3.专利权权人在标标准制定定过程中中故意不不披露相相关专利利权信息息以获取取不正当当利益；4.专利权权人利用用

8、标准制制定进行行联合抵抵制；55.交叉许许可和专专利联营营中的专专利权滥滥用问题题。就国国家技术术标准而而言，主主要容易易出现前前三种法法律问题题。第二部分分“美国、欧欧盟国家家技术标标准中专专利政策策研究”主要着着眼于对对国外国国家标准准体系和和相应专专利政策策的梳理理和分析析。首先先，经过过研究我我们发现现，我国国的国家家技术标标准的含含义、分分类和制制定模式式与发达达国家所所普遍采采用的体体系有很很大的差差异，特特别是在在大多数数发达国国家并没没有与我我国强制制性国家家标准内内涵完全全一致的的概念。如如果我们们仅仅按按照“强制性性国家技技术标准准”进行检检索则无无法检索索到有价价值的研研

9、究资料料，因此此本报告告将研究究范围扩扩展到了了“强制性性/推荐荐性国家家标准”的范畴畴。在此此基础上上，我们们分别收收集整理理了美国国、欧盟盟自愿性性/推荐荐性国家家技术标标准制定定中的专专利政策策，并对对美国欧欧盟自愿愿性标准准向强制制性标准准转化的的模式进进行了分分析，较较全面系系统地展展示了美美国欧盟盟国家标标准体系系的构成成及其专专利政策策的要点点。在第第二部分分的最后后，我们们对美国国、欧盟盟国家技技术标准准中专利利政策的的成因进进行了分分析，并并得出结结论：美美国、欧欧盟标准准化组织织的专利利政策是是与其标标准化体体系相适适应的，而而其标准准化体系系的建立立又是以以这些国国家社会

10、会经济状状况、科科学技术术发展水水平和整整体法律律环境相相适应的的。如果果完全无无视我国国标准化化体系与与美国、欧欧盟标准准化体系系的差异异，无视视我国社社会经济济、法律律、技术术发展状状况的特特点，照照搬发达达国家的的专利政政策将导导致因无无法有效效防止和和妥善解解决国家家技术标标准中的的专利纠纠纷问题题而严重重阻碍我我国国家家技术标标准制定定实施的的后果。总报告第第三部分分“我国国国家技术术标准体体系及其其专利政政策研究究”从对我我国国家家技术标标准体系系概况的的介绍分分析入手手，对目目前我国国国家标标准中专专利政策策情况进进行了归归纳总结结与分析析，就其其中不合合理之处处进行了了详细阐阐

11、述。对对我国目目前正在在制定的的国家技技术标准准中的专专利政策策，我们们总的看看法是（11）将专专利技术术排除在在强制性性国家标标准之外外不科学学；（22）国家家标准化化委员会会在推荐荐性国家家标准专专利政策策上的态态度应该该更强硬硬；（33）在反反垄断法法缺位的的情况下下，国家家标准化化管理委委员会和和国家专专利局应应该承担担更多的的职责，保保障国家家标准的的制定与与实施。我我们认为为国家标标准中的的专利政政策必须须与一国国的标准准体系相相协调，而而该标准准体系又又必须反反映该国国科学技技术、社社会经济济和法律律制度的的特点。以以此为出出发点，我我们就完完善我国国国家标标准体系系及其专专利政

12、策策提出了了三套建建议方案案，分别别阐述其其要点和和利弊，供供有关立立法行政政部门进进行参考考。总报告第第四部分分就国家家技术标标准中纳纳入专利利后对专专利法的的冲击和和可能的的专利法法修改进进行了论论述。本本部分报报告以国国家技术术标准中中可能出出现的专专利纠纷纷为切入入点，分分别分析析了这些些专利纠纠纷的表表现方式式和产生生原因，并并详细设设计了解解决这些些纠纷的的法律途途径。首首先，报报告建议议通过完完善对发发明专利利的审查查制度和和综合运运用标准准化领域域的行政政法规、规规章、专专利法中中的无效效审查制制度等法法律途径径，解决决由信息息不对称称引发的的专利权权与国家家技术标标准相冲冲突

13、问题题。其次次，报告告建议，通通过对发发明专利利实质性性审查制制度的完完善解决决由于国国家技术术标准中中专利技技术状况况不明确确而影响响标准制制定实施施问题；最后报报告以第第三部分分所设计计的三套套国家标标准体系系及其专专利政策策方案为为基础，提提出综合合运用专专利强制制许可制制度、委委托代理理合同和和居间合合同以及及对专利利权滥用用的反垄垄断规制制解决专专利权人人拒绝许许可影响响国家技技术标准准制定实实施的问问题。在总报告告附件中中，我们们以表格格的方式式罗列了了解决上上述三方方面问题题所涉及及的对法法律法规规司法解解释以及及行政规规章的修修改内容容；并就就为解决决第三个个问题所所设计三三种
