10、双方协商同意,可以变更工作地点。(二)乙方应按甲方的要求,按时完成规定的工作数量,达到规定的质量标准。注:工作地点是劳动法新增的必备条款。对于类似“因生产经营需要,劳动者愿意服从用人单位调整工作岗位”或“用人单位有权根据生产经营需要调整劳动者工作岗位”等条款,不再写入合同。原因在于:调整工作岗位属于变更合同行为,按照劳动法规定,变更需采用书面形式,因此,此约定涉嫌剥夺劳动者的合同协商变更权,用人单位免除自己的法定责任、排除劳动者权利的条款无效。第三条工作时间和休息休假(一)乙方实行以下工时制。1、实行不定时工作制的,工作时间和休息休假甲乙双方协商安排。(二)甲方因工作需要安排延长乙方工作时间的

27、门所属社会保险机构缴纳社会保险费,其中乙方应缴纳部分由甲方从乙方工资中代扣代缴。(二)乙方因工负伤(死亡)和患职业病,依法享有获得医疗救治、经济补偿的权利。(三)乙方在劳动合同期内患病、非因工负伤,依法享有国家规定的医疗期。(四)乙方的福利待遇按国家及甲方的规定执行。第七条劳动合同的变更、解除、终止、续订(一)有下列情形之一的,甲、乙双方可以变更本合同:1.在不损害国家、集体和他人利益的情况下,双方协商一致的;2.劳动合同订立时所依据的客观情况发生了重大变化,经与乙方协商一致的;3.由于不可抗力的因素致使劳动合同无法完全履行的;4.劳动合同订立时所依据的法律、法规已修改的;5.法律、法规规定的

44、失,应由乙方全额承担。(3)乙方未按照本合同第一条规定的到岗日到岗的,本合同自到岗日满后自动失效,但甲方认可的除外。由此给甲方造成的损失,应由乙方全额承担。(4)本合同的附件与本合同具有同等效力。但如果本合同的条款与附件内容有任何冲突或不一致之处,则以附件中的内容为准。(5)本合同履行过程中,若甲方变更名称、法定代表人或者主要负责人、投资人等事项,不影响本合同履行;若甲方发生合并或分立等情况,本合同继续有效,由承继单位继续履行。(6)乙方在合同期内,属其岗位职务行为或主要利用甲方的物质技术条件所产生的所有专利、版权和其他知识产权归甲方所有,乙方无权进行商业性开发。精品资料-欢迎下载-欢迎下载
