14、出现各方面的问题：招标方进行规避招标或暗箱操作的假招标、流于形式的资格审查、以及在招标过程中所表现出的明显倾向性、泄露标底等问题；投标方不遵守市场诚信规则，串标围标、假借资质等问题；招投标代理机构的不规范问题；政府在行政监督方面的缺失等问题。针对产生的问题，从行政监督角度入手，可以发现目前我国政府建设工程招投标过程中出现的种种问题，既有其客观原因，也有其主观原因。招投标本身法律、法规体系尚不健全，法律法规的执行不到位；政府建设工程招投标的制度设计不合理；对招投标的行政监督和制约机制力度不够，对违法犯罪的惩治缺乏力度等，是政府建设工程招投标过程中出现诸多问题的重要原因。建议健全招投标的法律法规制

15、度，加强法律法规的可操作性；完善对政府建设工程招投标的行政监督体制，从横向和纵向两个方面完善对政府建设工程招投标的管理；检察权介入政府建设工程招投标，充分发挥检察机关的预防作用，推动政府建设工程招投标的健康发展。关键词：政府建设工程招投标行政监督检察权山东大学硕士学位论文ABSTRACTChinese government bears the ability of construction，and it often participate in theproject construction as the role of tenderIt engineers construction acti

21、业务按照招投标程序和办法选择中标人的活动。虽然目前招标投标已经成为政府在建设工程中的主要交易方式，但是由于当前各方面的原因，在实践和理论中，政府建设工程招投标仍然存在着许多问题。在实践中，由于招标投标制度及对其进行行政监督的制度不完善，政府建设工程的招标投标活动仍然存在透明度不够、行为不规范、监督效率低下、信用体系的建设滞后等问题，导致招投标活动问题频出。在理论研究中，对政府建设工程招投标的重视程度不够，或重视招投标自身的程序而忽视对招投标活动的监督，因此需要加强对政府建设工程招投标方面的理论研究。1。12研究意义深入研究政府建设工程招投标活动或制度，具有深刻的理论意义和重大的现实意义。一、理
